The client had purchased a Grade II listed property on the assurance—based on the solicitor’s report—that it was connected to mains water. Upon commencement of development, it became apparent that no such connection existed, resulting in significant delay. The water supplier quoted a figure that was exorbitant to the developer for connection works, while the client’s current solicitors proposing an even larger fee to pursue an insurance claim against the supplier.

Advice and Solution

Counsel advised that the appropriate next step would be to issue letters of notice to both the water supplier and the former solicitor, inviting them to consider their respective positions and potential liability.
