Counsel Assists Landlord Evicting a Tenant – From Eviction Notice to the Bailiffs

Facts

A client wished to sell a property and relocate abroad, but the tenants had fallen behind on rent and showed no signs of catching up. To move forward with the sale, the client needed to regain possession of the property and instructed Counsel to assist with the eviction process.

Issues

The matter was complicated by persistent difficulties. The tenants resisted every stage of the process and failed to comply with eviction orders. At the same time, the county court was slow to formalise the orders that Counsel had successfully obtained, creating further delay and forcing the client to incur additional costs in pursuing enforcement.

With the property recovered, the client was finally able to complete the sale and move on to the next chapter of their life abroad.
